A settlement has been reached regarding a lawsuit that stems from an incident between the Nevada Highway Patrol (NHP) and a man who was beaten and arrested after being suspected as a drunk driver during a diabetic shock. According to reports from FOX 5 News, the man and his family was awarded $292,000 in damages.

The incident took place in October of 2010 near Lake Mead and the Boulder Highway in Henderson, Nevada. NHP Troopers and Henderson officers had pulled the man over after observing the man driving as if he were drunk. Little did they know the man was a diabetic and had gone into insulin shock while behind the wheel.

The man pulled the car over, but was unresponsive when officers and troopers approached the vehicle. Video footage from squad car dash cams shows officers tearing the man out of the vehicle and bearing him until he was on the ground, motionless.

Paramedics were not called to assist the man until officers found insulin in the man’s pockets during a search of his person.

Henderson city council members agreed to pay the victim $158,500 in damages, while the state will pay $35,000. The man’s wife was also awarded $99,000 from the state.

February 1, 2012

More information is coming to light surrounding the tragic accident that left a 12-year-old Spanish Springs, Nevada, boy seriously injured while riding his bike. Reports from 8 News Now say that the boy was holding on to his mother’s vehicle while it was moving at the time of the accident.

Reports of the incident from the Washoe County Sheriff’s Department indicate that the accident happened at 5:38 PM at the 400 block of Rockwell Boulevard. The boy was grabbing for the tail end of his mother’s pickup truck when he lost control of his bike, fell off, and his head on the asphalt.

The boy lost a large amount of blood and was still bleeding heavily when rescue crews arrived. The boy was the airlifted by CareFlight helicopter to Renown Regional Medical Center for treatment of serious, but non-life threatening, injuries.

The act of attaching on to a moving vehicle of any kind by a person on a bike, skate, or sled is not only illegal and punishable by law, but also extremely dangerous and potentially fatal. Broken or dislocated joints and bones, cuts, scrapes, and traumatic brain injuries are just a few of the commonly seen injuries associated with the activity.

The Nevada bicycle accident lawyers with the Richard Harris Law Firm ask that cyclists and skaters keep themselves and others safe by always wearing helmets and never attempting to hold onto a motorized vehicle while it is moving.

January 30, 2012

Federal health officials are conducting an investigation into the Luxor Hotel in Las Vegas, Nevada, after three guests reportedly became ill after their stay. According to 8 News Now, two patients were hospitalized and another died after investigators believe they contracted Legionnaire’s Disease during their stay at the hotel.

While the Southern Nevada Health District has conducted water sampling at the hotel, no sign of the disease has been found after three past guests were confirmed to have the disease just days after their stay at the facility. The district says it will continue its investigation until the source of the bacteria is found.

Legionnaire’s disease is a form of pneumonia that can categorized by high fever, chills, cough, muscle aches, and headaches. The onset of these symptoms occurs within two to fourteen days of contracting the disease. The disease can be treated with antibiotics, but testing is required to confirm the diagnoses before they can by given.

Hotel operators have a responsibility to provide guests with a safe environment during their stay. Failure to do so that results in a guest becoming seriously ill could be considered negligence.

September 29, 2011

Most drivers know how dangerous animals in the road, such as deer, can be. Some residents of Reno, Nevada, have a much larger problem…wild horses. According to Channel 4 News, seven horses have been hit by motor vehicles this month alone. Luckily, no people have been injured yet.

That is why Nevada Highway Patrol (NHP) officials are warning drivers to be cautious of the large animals. NHP Spokesperson Trooper Chuck Allen stated, “In light of the two animals that were struck within the past week, we thought it would be great information to let the motorists know that they are out there.”

The warnings have been issued for SR 341, or Geiger Grade, and for a section of highway near a roundabout at Veterans Parkway and Virginia City. Two horses were hit and killed in this area over the past week. Two weeks ago, four horses were struck and killed in a three-day period in this same area. Reports of wild horses have also come from US 50 in Lyon County near Mound House and Silver Springs. Authorities encourage drivers to slow down on curvy roads in these areas, especially at night.

The Nevada Car Accident Attorneys with the Richard Harris Law Firm know just how difficult it can be handling the fallout of a car crash that was not your fault.
School is supposed to be a place where parents can rest assured that their children are safe—that includes the roads around the school. That’s why some parents of students at Kitty Ward Elementary School are, according to Action News 13, in an uproar with Las Vegas Metro School officials.

The parents say that the intersection at Jones and Horse is too busy for children to cross without a crossing guard. School officials changed the school’s start times, causing an increase in traffic in the area around the school. One parents says that is not the only problem and added, “It’s still 35mph. There’s no stoplight; the kids can’t use a button to walk across.” Some parents have even stopped letting their children cross at the intersection alone and now meet them before and after school for the crossing.

A Metro Crossing Guard Supervisor was at the busy roadway several days after receiving complaints from parents and determined there is a need for a guard a the site; however, no decision or action has taken place.

The Las Vegas Personal Injury Attorneys with Richard Harris Law Firm applaud these parents for being proactive in acting upon what they saw as a dangerous situation. Without this information, school officials may not have acted and a child may have been hurt.

August 12, 2011

Five Las Vegas, Nevada roofers were taken to the hospital following a fire on a restaurant roof they were working on. According to 8 News Now, firefighters responded to a two-alarm blaze at a Jack In The Box fast food restaurant on Decatur Boulevard near Washington Avenue on Thursday afternoon.

Investigators said that the blaze started accidentally while the crew of workers was using a torch to heat tar for the roof. A crew of 75 firefighters worked to extinguish the flames, which caused nearly $1 million in damages to the building. Area traffic had to be diverted from the area, causing major delays for several hours.

Two of the roofers were transported to area hospitals and treated for smoke inhalation, while three others were checked out as a precautionary measure.

According to the Journal of Respiratory Medicine (JRM), victims of smoke inhalation can suffer life long side effects from the exposure. They found that nine out of fourteen people involved in the case study reported respiratory inflammation, in the form of hoarseness, cough, and breathlessness, six months after exposure.

August 5, 2011

A security researcher pointed out some shocking gaps that computer hackers could take advantage of in order to hack into many different types of medical devices. According to a report by 8 News Now, the findings were presented Thursday at the Black Hat Digital Security Conference at Caesars Palace in Las Vegas, Nevada.

At the conference, the security researcher Jay Radcliffe showed how hackers could control medical devices such as insulin pumps to alter readings on devices such as blood-sugar monitors. Radcliffe said, “If somebody gets hurt through a medical device being tampered with and potentially dying, it raises the stakes a bit. If one person were to be harmed, it would be a very big deal. It would be front page news everywhere.”

Although Radcliffe has only experimented with manipulating his own devices, others say the implications could be larger than just insulin pumps. One registered nurse said devices such as pace makers and medical records are also vulnerable. “The medical people like to connect in remotely, read the records, change the pump, change your pacemaker, and they’re not aware.” He continued, “Those that are aware don’t want to talk about it, that these are vulnerabilities in the field.”

Currently, there is no federal agency overseeing security of wireless medical devices and industry representatives downplay the potential threat.

The Nevada Defective Product Attorneys with the Richard Harris Law Firm make it their mission to fight for those who were injured by a product that did not work properly.

July 22, 2011

The cause of a fire in a mobile home near Carey Avenue and Nellis Boulevard, in which a Las Vegas woman and six children were injured, remains under investigation. According to Channel 8 News, Clark County firefighters responded to the blaze early Thursday evening and were able to rescue all occupants of the house, as well as three dogs and three cats.

The woman and the children were transported to a local hospital to be treated for non-life threatening injuries. The woman sustained minor burns across her body and the children are being treated for smoke inhalation.

Although all victims of smoke inhalation in this case were treated and released, the damage done may cause long-term health effects according to one study. An article was released by the International Journal of Respiratory Medicine that followed victims of the King’s Cross underground station fire six months and two years after the tragedy to document any health effects. It showed smoke inhalation could be associated with injury to the small airways with nine of fourteen survivors reporting symptoms ranging from hoarseness to breathlessness. These studies show that just because you are released from a medical facility after being treated, your injuries can follow you for a many years, perhaps even a lifetime.

The Nevada Fire Injury Attorneys with Richard Harris Law Firm understand the life-long effects fire and smoke related injuries may cause and work to ensure that their clients are compensated fairly for the suffering they have endured.

Nevada state legislature has added an updated distracted driving law to the books that makes it illegal to text and drive or talk on cell phones while behind the wheel, but it won’t become official for another couple of months. The legislation made headlines earlier this week when police released information indicating that the ban would be enforced beginning July 1st instead of October 1st, when most new take effect.

According to a report by the Las Vegas Sun, Metro Police tweeted that they’d pull drivers over for the infraction starting on the first day of July. This prompted the Nevada Public Safety Department to issue a press release stating the law would not be enforced until October 1st. Even then, offenders will only receive a verbal warning; police cannot issue actual citations until January 1st of next year.

Distracted driving has become one of the top three causes of fatal accidents, ranking among speed and alcohol as a top killer. In recent years, many states have created laws to curb cellphone use by drivers. To this date, more than 35 states have such legislation on their books, as lawmakers wait to see if their work makes a difference in lowering the number of accidents and fatalities.

Hospitals are places that we go to in order to heal our bodies and get better. But, what if the hospital was the place where your child was being held from you against your will? That is exactly what one Las Vegas couple had to deal with and now they want an apology.

After the couple’s baby was born, she was taken to the intensive care unit to be treated for jaundice. After getting a second opinion from their pediatrician, the couple told the hospital that they wanted their baby back home.

Action New 13 quotes the mother as saying, “Our pediatrician told us she was fine, and that it would be okay to monitor her from home. Her levels were normal.”

Instead of releasing the child from intensive care, the hospital instead called Child Protective Services (CPS) . The new parents claim that a CPS officer and hospital security guard came in and told them that if they tried to take their child home they would be arrested, contrary to a medical release form they signed.

The child has since been released from the hospital. The couple says, “We wrote a letter to the hospital and we’re just basically waiting to hear back and get what’s fair.”

What would you do if a hospital held your child against your will?

Nevada medical malpractice attorneys may be able to answer questions regarding billing for services a victim does not want or need and receive anyway. Richard Harris Law may be able to help in a case like this.
