			<content:encoded><![CDATA[<p><a href="http://blog.richardharrislaw.com/wp-content/uploads/2010/09/las-vegas_3964826211238431818.jpg"><img class="alignnone size-medium wp-image-437" title="las-vegas_3964826211238431818" src="http://blog.richardharrislaw.com/wp-content/uploads/2010/09/las-vegas_3964826211238431818-300x225.jpg" alt="" width="300" height="225" /></a>My perusal of the RJ this past Sunday filled me with a sense of ambivalence.  Of course plastered on the front page was the big news about Paris Hilton’s arrest on cocaine possession.  Who’d have guessed?  For more on this click <a title="here" href="http://www.ticketbusters.com/blog/" target="_blank">here</a>.</p>
<p>Besides this, there were many items which didn’t give much of a sense of warm and fuzzy.  I won’t quote the RJ, so as not to incur the wrath of their new copyright attorney, but a review of articles goes like this (according to my feeble memory):</p>
<p>Item – A poll that people in Las Vegas are not feeling secure with the economic conditions in town.  That’s no big surprise, but the same poll found that people don’t hate it enough to leave.</p>
<p>Item – A full page advertisement/announcement of Station Casinos having their reorganization plan confirmed by the court, which paves the way for the Stations to come out of bankruptcy as a viable company.</p>
<p>Item – Forbes magazine has found Las Vegas to be the most stressful city in the US, this two weeks after the same Forbes magazine found Vegas to be the “Coolest City in America”</p>
<p>Item – on the Sun front page that a middle class man is about to become homeless as his home is foreclosed.</p>
<p>This coupled with subsequent news from other sources that 3 out of 4 mortgages in Nevada are underwater, i.e. the house is not worth the balance of the mortgage, can give one a sense of hopelessness, and perhaps even dread.  No wonder this is the “most stressful” city in the US.</p>
<p>At the same time, this really is the coolest city in America.  I’ve told out of town friends that it’s a pretty good town to live in, with an incredible entertainment district.  On any given night in this town, we can see any number of big name rock and roll bands perform, and then there’s always the Cirque shows (are we up to 10 different ones now?), and, of course, any number of vices are indulged and even encouraged in this town, if you’re into those types of things. </p>

			<content:encoded><![CDATA[<p>Michael Galardi, 48, a former strip club mogul who admitted bankrolling corrupt politicians in San Diego and Las Vegas in the political scandal that became known as Operation G-Sting, appeared March 5 before U.S. District Judge Jeffery Miller and asked for early termination of his supervised release (the equivalent of parole &#8212; which was to end in January 2012).<br />
Attorney’s for Galardi say that he has paid his debt to society, was a model prisoner, and cooperated with law enforcement officials in two trials that led to convictions of several former politicians.<br />
In March, 2007, Galardi was sentenced to 30 months in federal prison, followed by three years of parole, a $100,000 fine, and $400,000 in restitution to be paid to the city and county.<br />
Miller sided with San Diego prosecutors who urged him to deny the motion but change the defendant&#8217;s remaining term of supervised release to unsupervised. Galardi Attorney, Robert Rose stated that this ruling means Galardi is still subject to the jurisdiction of the court.&#8221;<br />
Galardi was released on Jan. 5, 2009, after spending 18 months in custody for bribing politicians in San Diego and Las Vegas.</p>

			<content:encoded><![CDATA[<p>The Nevada Supreme Court in Carson City, upheld death penalties in two separate cases. On Thursday, Justices unanimously upheld the conviction of James R. Walker and affirmed the death sentence of Tamir Hamilton.</p>
<p>Walker was convicted of killing a Las Vegas woman, Christine Anziano, 33, in August 2003. Justices were split 4-3 over whether he deserved a new penalty hearing. Besides first-degree murder, Walker also was convicted of five other counts for crimes committed against two other people within 24 hours of Anziano&#8217;s death, including slitting one man&#8217;s throat.<br />
Hamilton, was convicted of the 2006 rape and killing of 16-year-old Holly Quick. Quick&#8217;s mother found her body when she went to awaken her for school.</p>
<p>Both Walker and Hamilton, who are black, argued the trial courts erred by denying their objections to the prosecution&#8217;s use of peremptory challenges against blacks in their jury pools.<br />
Walker, in his appeal, also argued the trial judge erroneously limited his attorney&#8217;s questioning of potential jurors, that he should have been tried separately on the three incidents, and that statements by the prosecutor were improper.</p>
<p>Hamilton argued he was improperly denied from pursing an insanity defense when the court wouldn&#8217;t allow his expert witness to testify about out-of-court comments Hamilton had made, and that executing him would violate his Eighth Amendment right against cruel and unusual punishment because he is a schizophrenic.<br />
Justices upheld his conviction and sentence 6-1. In a dissent, Cherry said the prosecutor&#8217;s reasons for excusing the only two black potential jurors were &#8220;pretexts for racial discrimination,&#8221; and therefore Hamilton deserved a new trial.</p>

			<content:encoded><![CDATA[<p>The Nevada Supreme Court reversed the conviction of the man who shot a Las Vegas teen. The Nevada Supreme Court on Friday overturned the murder conviction of Donald Schuster.</p>
<p>Schuster was convicted in 2006 for the death of 16-year-old Jon Michael Ginoulias. After a heated argument with Ginoulias and Nick Erichett, the teen’s friend, Schuster went to his house and came out with a handgun and started shooting. </p>
<p>Schuster claims he fired his gun in self defense and that he never intended to kill Ginoulias or injure Erichetto.</p>
<p>Schuster was sentenced to life in prison. His attorney appealed the conviction, claiming the presiding judge, Donald Mosley, refused to instruct the jury on the lesser charge of involuntary manslaughter. The Nevada Supreme Court last week agreed and overturned the jury&#8217;s conviction.<br />
Schuster is  awaiting a new trial. </p>

After murdering Candela, Lane stuffed her severed body in a trash barrel, and later used her vehicle to hit a transsexual man he met for sex.<br />
The Clark County district attorney is seeking the death penalty for Lane. In addition, prosecuters want to combine murder and attempted murder with a vehicle cases against 37-year-old Lane. Lane is currently being held without bail.</p>

			<content:encoded><![CDATA[<p>Anita Mann, the 19-year-old accused of driving drunk and killing two people on February 16, appeared in a Henderson courtroom Wednesday morning.<br />
After a judge ruled Mann as a danger to society, Mann’s father defended her by saying that she was not a partier or a drinker and never even had a parking ticket. Mann attended CSN and her parents describe her as a good kid who made good grades.<br />
Nevertheless, her bail was set at $225,000 and her preliminary hearing is scheduled for March 11th.<br />
Mann is facing two counts of felony DUI for the deaths of 66-year-old Louis Madden and 65-year-old Karen Hicks who were killed on February 16th.<br />
Police say Mann&#8217;s blood alcohol level was more than three times the legal limit.</p>
<p>Mann did not give an explanation as to how she obtained the alcohol early Tuesday morning. </p>
<p>Mann&#8217;s attorney, Steve Wolfson, commented on how this situation is a tragedy for both families involved. We agree. </p>

<p>If you want to know the secret to a successful practice, just ask attorney Richard A. Harris who has been in the community helping injured people for thirty years.</p>
<p>“It’s plain and simple, treat people like human beings,” said Harris while speaking to senior students at the UNLV Dental School on the topic of jurisprudence.</p>
<p>An apology goes a long way according to the Las Vegas Attorney. When physicians are involved in legal disputes with patients Harris advises our future doctors to take the high road- be compassionate, take the time to explain, and most importantly give them answers.</p>
<p>Harris cited many cases where physicians made medical mistakes and never took the time to explain; for instance, why the wrong knee was operated on, or why a couple’s baby died when the baby was thriving the night before.</p>
<p>“When you come in to court and I have you up on the stand, take the wind out of my sails, just admit you made a mistake.”</p>
<p>Harris also cleared up misconceptions about medical malpractice clients that are portrayed in the media as wanting to make a quick buck.</p>
<p>“Most of the time, people come in because they have mounting medical bills and they cannot afford to pay them. People are just happy when things go wrong, you fix them, don’t avoid your responsibility.”</p>
<p>After the lecture, Harris took questions from the dental students and congratulated them on their senior year.</p>

			<content:encoded><![CDATA[<p>It’s been said before support groups have been proven to work. Think of any outrageous topic- <em>Daughters of Narcissistic Mothers</em>? You are sure to find a group that shares the same thoughts, hobbies, financial issues, family struggles and joys.</p>
<p>This is the best way I can describe the conference that the Richard Harris Law Firm attends every six months. It’s called M &amp; L Seminar the Legal Marketing and Management Forum.</p>
<p>Basically, it is made up of attorney-entrepreneurs who share the same employment issues, marketing ideas and conflicts.</p>
<p>Our winter session (Jan 14, 15, 16) was held in Costa Rica. What a sacrifice right? And, it was paid for by our boss, yet another big sacrifice during the cold winter weeks in Las Vegas.</p>
<p>In exchange we promised to absorb and implement as soon as we returned- great motivation for our next trip to a far away island right boss?</p>
<p>Among those who attended were, Susan Syring, our HR Director, Me &#8211; the Marketing Director, Shoshana Kunin-Leavitt our newest attorney and two old-school attorneys – Josh Harris, Dave Boehrer, and our fearless leader, Richard A. Harris</p>
<p>Subjects include, customer service, marketing, best and worst management decisions, only to name a few.</p>
<p>We absorbed as much as we could throughout the day- because there were some distractions like, the perfect weather, the beach, on-call alcohol, the beautiful hotel and something called zip lining.</p>
<p>Yes, three of us went zip lining and I suddenly remembered why companies take retreats and do things like zip lining and corporate challenges- they scare people into getting along – like being in a fox hole together.</p>
<p>Ever heard of the saying <em>there are no atheists in fox holes</em>- well, there are no enemies in fox holes either.</p>
<p>Not that we had any problem getting along before the seminar, we actually did not interact enough to know better. Long story-short, we definitely bonded packed inside the zip line platform 90 feet above the rainforest. Yep, that’ll do it!</p>
<p>Zip lining scared me out of my wits! And although I didn’t show it I was uncertain about my freaking out meter going out of control.</p>
<p>However, Susan and Shoshana talked me through it and made monkey noises as I zip lined my way above the rain forest. I could not stop laughing!</p>
<p>As we walked and talked through the forest, I remembered how before the plane took off, Susan noticed I was uneasy. Susan grabbed my hand and told me a funny story about a meditation word she used- <em>Wasabi&#8230;</em></p>
<p>I realized that this is the way a work team should function, when one member is down the other members motivate, re-focus, talk them through, hold their hand if needed and get them to reach their ultimate potential until they can fly.</p>
<p>Well…I did just that. Look at me fly!</p>
